These terms (the "Developer Agreement") are between anySKU, LLC, a Georgia limited liability
company ("anySKU," "we"), and the person or organization registering an app ("you"). If you
register an app for an organization, you confirm you are authorized to accept these terms for it, and
"you" means the organization.
This Developer Agreement adds to the anySKU Terms of Service (the "Terms"). If they conflict about your
app, this Developer Agreement controls. If you have also signed an anySKU Partner Agreement, that
agreement controls where it conflicts with this one.
1. Definitions
- App: software you register with anySKU that people connect to their anySKU accounts.
- Users: people who connect your App to their anySKU account, or to an account they run for an
organization.
- User Data: anything your App receives from anySKU about a User or acting for a User, including
copies and anything derived from it.
- Credentials: your App's client ID and secret, and the tokens your App receives.
2. Registering and review
2.1 Tell the truth. Your App's name, description, website and return addresses must be accurate. Don't
name your App in a way that suggests it is made by, or endorsed by, anySKU or anyone else it isn't.
2.2 Review. Until anySKU approves your App, only your own people can connect it (you, or your
organization's members). anySKU decides whether to approve an App, may ask for more information, and may
approve, reject or later suspend any App, including for reasons it isn't able to share.
2.3 Ask only for what you need. Request only the permissions your App needs for what it does for
Users. Once approved, your App can't ask for more without a new review.
3. Users decide
3.1 Consent on anySKU. Users connect your App only on anySKU's own consent screen, which lists what your
App can do. You will not ask Users for their anySKU password or one-time codes, or try to connect without
that screen.
3.2 Explain it yourself too. Before sending a User to anySKU, tell them in plain words what your App
will do with their information.
3.3 Privacy policy. Your App must have a privacy policy that Users can find before they connect, that
covers User Data, and that you follow.
3.4 Disconnecting. Users can disconnect your App at any time, and its tokens then stop working. When a
User disconnects, or your App is suspended or deleted, you will stop using that User's User Data and
delete it within 30 days, except records you must keep by law or for your own accounting of money
you actually received.
4. What you may do with User Data
4.1 Only for the User. Use User Data only to provide the features of your App that the User connected
it for, and to keep your App secure and working.
4.2 Not allowed. You will not:
- sell, rent, license or give User Data to anyone, except your own service providers acting for you under
written terms at least as protective as these;
- use User Data for advertising, or to contact Users for marketing they haven't agreed to;
- try to identify buyers or any other person anySKU doesn't identify to you;
- use User Data to build a competing marketplace, or to copy anySKU's listings, categories or data in bulk;
- use User Data to train or improve a general-purpose AI model; or
- do anything with User Data that the User couldn't do themselves on anySKU, or that the Terms forbid.
4.3 Organizations' apps. If an organization owns your App, it receives a User's information only where
it relates to that organization (for example, the User's sales at its events). Don't use it for anything
else.
5. Acting for Users (writes and agents)
These apply as anySKU opens actions that change things (listing, offering, buying, messaging):
- Act only on the User's instructions, and only within the permissions they gave.
- Anything that can't be undone (buying, accepting an offer, sending money) needs the User's confirmation
in anySKU, where anySKU asks for it. Don't try to get around that step.
- Respect any spending or activity limits the User sets.
- Messages and offers your App sends are shown as sent through your App. Don't hide that.
- An automated agent must not pretend to be a person.
- You are responsible for what your App does, including mistakes by any AI it uses.
6. Security
6.1 Credentials. Keep your secret and tokens on your servers, never in a web page, a mobile app or a
shared document. If you think one has been exposed, replace the secret at once and tell anySKU.
6.2 Protect User Data with reasonable safeguards suited to its sensitivity: access limited to people
who need it, encryption in transit, up-to-date software.
6.3 Breaches. Tell anySKU at security@anysku.com within 72 hours of learning that User Data has
been accessed, used or disclosed without authorization, and cooperate in the response, including notifying
Users where the law or anySKU reasonably requires.
7. Using the API
7.1 Use only anySKU's documented API, within its rate limits. Don't try to get around limits or
permissions, reach information your tokens don't allow, or scrape anySKU.
7.2 anySKU keeps a record of calls made with your Credentials (kept 90 days) to run, secure and support the
API.
7.3 anySKU may change or retire parts of the API. We will give 30 days' notice by email before a change
that would break a correct integration, unless it's needed sooner for security, legal or abuse reasons.
7.4 The API is free for now. If anySKU charges for it later, we'll give 60 days' notice first.
8. anySKU's name
You may say your App "works with anySKU." Don't use anySKU's logo, or imply anySKU endorses, sponsors or is
responsible for your App, without our written consent. Don't state or imply that anySKU makes any donation,
charitable or tax statement, or issues any receipt (Terms §8.4).
9. Suspension and ending
9.1 anySKU may suspend your App, revoke its Credentials, or end this Developer Agreement at any time if we
reasonably believe you or your App broke these terms or the Terms, put Users or anySKU at risk, or stayed
unused for a long period. Where we can, we'll tell you why and give you a chance to fix it.
9.2 You may stop at any time by deleting your App on anySKU.
9.3 When this ends, every connection to your App stops, and Section 3.4 applies to all User Data. Sections
3.4, 4.2, 6.3, 9.3, 10 and 11 continue after it ends.
10. Responsibility
10.1 As is. The API is provided "as is" and "as available." anySKU doesn't promise it will be
uninterrupted or error-free, or that any information is complete or final.
10.2 Limits on liability. anySKU is not liable for indirect, incidental, special or consequential damages,
or lost profits, even if warned. anySKU's total liability under this Developer Agreement is limited to
US $100.
10.3 Indemnity. You will defend and pay for claims against anySKU, its owners, officers and employees,
including reasonable lawyers' fees, to the extent they arise from your App, your use of User Data, or your
breach of this Developer Agreement.
11. General
Georgia law governs, without regard to its conflict-of-laws rules; disputes go to the state or federal
courts in Fulton County, Georgia. anySKU may update these terms by posting a new version and telling you by
email at least 30 days before it applies to you; if you keep your App registered after that, the new
version applies. Notices to anySKU go to legal@anysku.com. If a part is unenforceable, the rest still
applies.
