1. Agreement to Terms
Welcome to anySKU. These Terms of Service ("Terms") constitute a legally binding agreement between you and anySKU, LLC ("anySKU," "we," "us," or "our") governing your access to and use of the anySKU website, mobile applications, and related services (collectively, the "Platform").
Please read these Terms carefully. By creating an account or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our services.
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Platform. Your continued use after such notice constitutes acceptance of the updated Terms.
2. Eligibility
To use anySKU, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Be located in the United States
- Have a valid email address or phone number
- Not have been previously banned from the Platform
By using anySKU, you represent and warrant that you meet these eligibility requirements.
3. Your Account
3.1 Account Creation
To access most features of anySKU, you must create an account. Registration requires a verified email address or phone number (confirmed via a one-time verification code), a display name, a username, and a password. You may optionally add a secondary contact method, a profile photo, and your full name during onboarding or later through account settings. You agree to:
- Provide accurate and complete registration information
- Maintain one account per person
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access
3.2 Account Responsibilities
You are responsible for all activity that occurs under your account. anySKU is not liable for any loss or damage arising from unauthorized use of your account.
3.3 Account Termination
You may delete your account at any time through account settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. See our Privacy Policy for information about data handling upon account deletion.
4. Marketplace Services
4.1 Platform Role
Important: anySKU is a platform service that connects buyers and sellers. We are NOT a party to the underlying sale of goods between users. All transactions for goods are solely between the buyer and seller.
anySKU provides:
- A platform for listing and discovering items
- Communication tools for buyers and sellers
- Payment processing services (via Stripe)
- Meetup coordination tools
- Transaction verification features
Service fees are charged for use of the Platform services, not for the goods themselves.
4.2 No Endorsement
anySKU does not endorse, warrant, or guarantee any listings, sellers, buyers, or transactions. We do not verify the accuracy of listings or the identity of users beyond email/phone verification.
5. Listings and Content
5.1 Listing Requirements
If you list items for sale, you agree to:
- Provide accurate descriptions and photos
- Set honest pricing and condition information
- Have the legal right to sell the item
- Not list prohibited items (see Section 8)
- Honor accepted offers and purchases
5.2 AI-Assisted Listings
anySKU uses artificial intelligence to analyze photos and suggest listing details. You are solely responsible for reviewing and verifying all AI-generated content before publishing. anySKU does not guarantee the accuracy of AI-generated suggestions.
5.3 Listing Modes
anySKU offers different listing modes:
- Showcase Only: Display items in your collection
- Showcase + Offers: Accept offers on showcased items
- For Sale: Fixed-price listings
- For Sale + Offers: Accept direct purchases or offers
6. Transactions and Payments
6.1 Payment Methods
anySKU supports the following payment methods:
- Credit/Debit Cards: Processed securely through Stripe
- Cash: Exchanged in person at meetups
6.2 How Card Authorization Works
When you place an order, your card is authorized (not charged). This places a temporary hold on the funds. The hold is captured (charged) only after both parties complete the in-person meetup verification and the buyer accepts the item(s). If the order is cancelled for any reason before the meetup is completed, the authorization hold is released and your card is not charged.

Payment processing typically completes within moments of item acceptance. In some cases, additional processing time may be required. You will be notified through the app when your payment has been finalized.
6.3 Seller Order Review
Certain orders may require the seller's review before a meetup can be scheduled. This may occur when:
- The buyer selects a private meetup location
- The order total exceeds a review threshold set by the seller
- The seller has chosen to review all incoming orders
During the review period, the buyer's card authorization remains as a hold only. The seller has a limited time to respond (typically 72 hours). If the seller does not respond within the review period, the order is automatically cancelled and the authorization hold is released. The seller accepts an order by proposing meetup times; the seller may also decline the order, in which case the hold is released immediately.
6.4 Service Fees
anySKU uses a split fee model where both buyers and sellers may pay fees depending on their subscription plan and payment method. Fees are only charged on completed transactions. No fees are charged if the meetup is cancelled, the seller declines the order, or the order times out.
Buyer Service Fee
Buyers pay a service fee (referred to as "service fee" throughout the Platform) based on their subscription plan. This fee covers anySKU platform services including buyer protection, secure payment processing, and — for coordinated meetups — meetup scheduling and verification. The service fee is added to the item price at checkout:

Sellers pay a processing fee on card transactions only (deducted from payout):

The seller processing fee is the same for all subscription tiers.
6.5 Seller Payouts
Sellers who accept card payments choose a payout method in their account settings: ACH direct deposit (typically 1–3 business days after transaction completion) or check by mail (typically 5–10 business days). All payment and bank account information is processed by Stripe. anySKU does not store full bank account or card numbers on its servers.

Fees are non-refundable once a transaction has been fully completed (items accepted by the buyer through the verification process). anySKU facilitates communication but does not guarantee refunds or mediate disputes between buyers and sellers.
6.7 Taxes
Listing prices on anySKU do not include applicable sales tax. Where required by law, anySKU may calculate and collect sales tax on your behalf at checkout. Sales tax is determined based on the transaction location and applicable state and local tax rates.
For card transactions, sales tax is included in the amount charged to your card. For cash transactions, sales tax is charged to your card along with the service fee. You are responsible for any tax obligations arising from your use of the Platform that are not collected by anySKU.
7. Meetups and Safety
Safety Warning: In-person meetups involve inherent risks. You meet with other users at your own risk. anySKU is not responsible for any harm, injury, or loss arising from meetups.
7.1 Meetup Locations
Sellers can designate public or private meetup locations. Private locations are only revealed to confirmed buyers after a purchase is made.
7.2 Safety Guidelines
We recommend (but do not require):
- Meeting in public, well-lit locations
- Bringing a friend for high-value transactions
- Inspecting items before completing the transaction
- Trusting your instincts and canceling if uncomfortable
- Using the in-app verification features for handoff confirmation
7.3 Verification Process
anySKU provides a two-way verification system for confirming handoffs. Both parties should verify completion through the app before finalizing the transaction.
7.4 Liability Waiver
By using anySKU to coordinate in-person transactions, you acknowledge and agree that:
- You meet with other users at your own risk
- anySKU does not verify user identities beyond email/phone
- anySKU is not responsible for any harm arising from meetups
- You will take appropriate safety precautions
- You release anySKU from all liability related to meetups
8. Prohibited Items and Conduct
8.1 Prohibited Items
You may not list the following (this list is not exhaustive):
- Illegal drugs and drug paraphernalia
- Weapons and ammunition (where prohibited by law)
- Stolen property
- Counterfeit or trademark-infringing goods
- Hazardous materials
- Recalled products
- Human remains or body parts
- Live animals
- Adult/explicit content
- Any item prohibited by applicable federal, state, or local law
8.2 Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Post false, misleading, or deceptive content
- Harass, threaten, or abuse other users
- Use the Platform for spam or unauthorized commercial purposes
- Attempt to circumvent security measures or rate limits
- Create multiple accounts or impersonate others
- Interfere with the Platform's operation
- Scrape, crawl, or systematically extract data from the website except through the documented Public API
- Systematically extract or replicate anySKU's product taxonomy or category structure for the purpose of replication
- Use the Public API to aggregate listing data across geographic regions beyond the intended local marketplace use
8.3 Transaction Monitoring
anySKU monitors transaction patterns and user activity to maintain platform integrity and protect the safety of our community. We may delay, hold, or decline transactions that our systems identify as potentially harmful. We are not obligated to disclose the specific criteria used in these determinations.
8.4 Enforcement
We may remove content, suspend accounts, or take other action against users who violate these Terms. Repeat violators may be permanently banned.
9. User Content
9.1 License Grant
By posting content to anySKU (including photos, descriptions, and other materials), you grant anySKU a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute such content in connection with operating and promoting the Platform.
9.2 Content Ownership
You retain ownership of your content. You represent and warrant that you have the right to post any content you submit and that it does not infringe on any third-party rights.
9.3 DMCA
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, please contact our DMCA agent at dmca@anysku.com.
10. Public API & Automated Access
10.1 Public API
anySKU provides a public Application Programming Interface (API) that allows third-party developers and AI-powered applications to access published marketplace data programmatically. The API provides read-only access to published listings, seller profiles, collections, and product categories.
10.2 Permitted Use
You may use the Public API to:
- Search and browse published listings within a geographic area
- View published listing details, seller profiles, and collections
- Build applications that help users discover local marketplace listings
- Integrate anySKU listing data into AI assistants and shopping tools
10.3 Restrictions
You agree not to use the Public API to:
- Systematically extract or replicate the full product taxonomy or category structure
- Aggregate listings across geographic regions to build a nationwide dataset
- Circumvent rate limits or access restrictions
- Access listings from sellers who have opted out of search discoverability
- Misrepresent the source of data obtained through the API
10.4 Rate Limits & Access
The Public API is subject to rate limits to ensure fair use and platform stability. anySKU reserves the right to throttle, suspend, or revoke API access for any consumer that violates these Terms, exceeds rate limits, or uses the API in a manner that degrades the platform experience.
10.5 Seller Discoverability Control
Sellers may control whether their published listings appear in search results and the Public API through their Privacy Settings. When a seller opts out of search discoverability, their listings will not appear in search or discovery results on the website or through the API. Their profile and listings remain accessible via direct link.
10.6 Automated Access Outside the API
Automated access to anySKU outside of the documented Public API (including web scraping, crawling, or robotic access) is prohibited without prior written consent from anySKU.
11. Dispute Resolution
10.1 Disputes Between Users
anySKU provides tools for communication but does not mediate or arbitrate disputes between users. If you have a dispute with another user:
- Direct Resolution: First attempt to resolve the issue directly with the other party through in-app messaging
- Platform Review: You may report policy violations to anySKU, and we may (but are not obligated to) review and take action on accounts
- External Resolution: You may pursue disputes in small claims court or through credit card chargebacks
10.2 Disputes with anySKU
Informal Resolution
Before filing any formal dispute, you agree to contact us at support@anysku.com and attempt informal resolution for 30 days.
Binding Arbitration
Arbitration Agreement: Any dispute arising from these Terms or your use of anySKU shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You agree to waive your right to a jury trial and to participate in class actions.
Exceptions: Either party may bring qualifying claims in small claims court. Either party may seek injunctive relief for intellectual property violations.
Class Action Waiver
You agree that any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ANYSKU DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
anySKU does not warrant that:
- The Platform will be uninterrupted or error-free
- Results from the Platform will be accurate
- Items listed are authentic, legal, or as described
- Users are who they claim to be
- Transactions will be completed successfully
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYSKU SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or data
- Personal injury or property damage from meetups
- Actions or omissions of other users
- Unauthorized access to your account
ANYSKU'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
- Fees paid by you in the 12 months preceding the claim, OR
- $100 USD
14. Indemnification
You agree to indemnify and hold harmless anySKU, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Content you post to the Platform
- Your conduct during in-person meetups
- Any transaction you complete through the Platform
15. Termination
These Terms remain in effect until terminated. You may terminate by deleting your account. We may terminate or suspend your access at any time, with or without cause, with or without notice.
Upon termination:
- Your right to use the Platform ceases immediately
- Provisions that should survive termination will remain in effect (including Sections 9, 10, 11, 12, 13, 14, and 16)
16. General Provisions
15.1 Governing Law
These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.
15.2 Venue
Subject to the arbitration clause above, any litigation shall be brought exclusively in the state or federal courts located in Fulton County, Georgia.
15.3 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and anySKU regarding the Platform.
15.4 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
15.5 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15.6 Assignment
You may not assign your rights under these Terms. anySKU may assign its rights without restriction.
